Cabinet of Ministers of Ukraine made changes to the procedure for disability payments or cash payments to families of the dead. The followingis presented in the new edition:
- The procedure for the appointment and payment of a one-time cash benefit in case of death or disability of certain categories of persons in accordance with the Law of Ukraine "On the Status of War Veterans, Guarantees of Their Social Protection", approved by Resolution of the CMU No. 336 of April 29, 2016;
- The procedure for the use of funds provided in the state budget for the payment of one-time cash benefits in the event of the death or disability of certain categories of persons in accordance with the Law of Ukraine "On the Status of War Veterans, Guarantees of Their Social Protection", approved by Resolution of the CMU No. 239 of March 17, 2023.
The purpose of the changes is to bring the mentioned Procedures into compliance with Law of Ukraine No. 3549-IX "On Amendments to Certain Laws of Ukraine on Improving the Procedure for Processing and Using Data in State Registers for Military Registration and Acquiring the Status of a War Veteran During Martial Law" and for the sake of simplification procedures for assigning and paying to persons with disabilities as a result of the war and family members of fallen (deceased) Defenders of Ukraine one-time monetary benefits in connection with the establishment of disability and one-time monetary benefits in connection with the death of a family member .
In particular, it is provided that the applicants will submit an application to the Ministry of Veterans Affairs for the appointment and payment of a one-time cash benefit, while the application can be submitted through the center for the provision of administrative services, and if it is technically possible (the implementation of an electronic cabinet), such an application will be possible to submit in electronic form by Diia portal or the Unified State Register of War Veterans. It was also established that the decision on the appointment and payment of one-time monetary assistance will be made by the Ministry of Veterans, and the funds of the one-time monetary assistance will be deposited by the Ministry of Veterans to the recipient's bank account.
The changes have been made to the Regulation on the Ministry of Veterans Affairs, according to which the Ministry of Veterans Affairs is empowered to appoint and pay one-time cash assistance, to implement methodical support of activities and, within the limits of the powers defined by law, to coordinate the interaction of central and local executive authorities, local self-government bodies, in including administrative service centers.
The Ministry of Finance of Ukraine published a draft of the order "On Amendments to the Instructions on the Application of the Chart of Accounts for Accounting of Assets, Capital, Liabilities and Business Operations of Enterprises and Organizations" (hereinafter – the draft order).
The draft order was prepared with the aim of bringing some of the norms of the Instruction on the Application of the Plan of Accounts for Accounting of Assets, Capital, Liabilities and Business Operations of Enterprises and Organizations, approved by Order of the Ministry of Finance No. 291 of November 30, 1999, into compliance with current legislation, in particular regarding the display in the accounting of economic transactions from the accounting of funds after the closure of user payment accounts by non-bank financial service providers, as well as economic transactions related to non-current assets held for distribution among owners.
In particular, the draft order proposes to supplement synthetic account 67 "Accounts with participants and customer funds" with subaccount 676 "Accounts of customers on inactive accounts" and correspondence of account 67 "Accounts with participants and customer funds" by debit and credit, as well as clarify the description accounts 28 "Goods" and 68 "Calculations for other transactions".
The Cabinet of Ministers of Ukraine adopted Resolution No. 1090 of September 24, 2024, which simplifies the procedure for assigning and paying one-time cash benefits in the event of death or disability of certain categories of persons in accordance with the Law of Ukraine "On Status of War Veterans, Guarantees of Their Social Protection".
Previously, decisions on the appointment of one-time cash assistance were made by the interdepartmental commission, and the funds were paid out by the social welfare authorities.
From now on, the Ministry of Veterans Affairs will make a decision on the appointment of a one-time financial aid and pay it out by crediting the funds to the recipient's bank account.
In particular, the new procedure will make it possible to speed up the terms of payments. For the appointment of the one-time cash benefits of persons with disabilities as a result of the war, which are specified in items 11-16 of the second part of Article 7 of the Law of Ukraine "On Status of War Veterans, Guarantees of Their Social Protection", and family members of the fallen (deceased) Defender of Ukraine, the relevant statement and documents can be submitted directly to the Ministry of Veterans Affairs, in particular, by postal means, or through the Centers for the provision of administrative services, regardless of the declared/registered place of residence.
The Ministry of Economy of Ukraine has adapted to the requirements of the European Union the rules for drawing up, submitting an application, conducting an examination and international registration of trademarks with the extension to Ukraine. The relevant order was approved by the Ministry of Economy on August 6, 2024, and entered into force on September 18.
The new rules are adapted to the regulations of the European Union and take into account Ukraine's international and European integration obligations, in particular under the Association Agreement between Ukraine and the EU. This will contribute to the promotion of Ukrainian manufacturers' products to European markets under trademarks registered according to European standards.
The rules regulate the following:
- who is eligible to apply;
- list of documents for the applicant;
- procedures for filing international trademarks under the Madrid System;
- peculiarities of examination of applications submitted according to national and international procedures.
The rules also:
- regulate the issue of submission of electronic applications and their examination;
- provide for the registration of the following types of trademarks — sound, positional, ornamental, motion, holographic, multimedia, as well as features of color and color combination registration;
- determine the procedure for verifying the fact of the application of sanctions against the applicant or the applicant state, as well as the legal consequences of the applied sanctions.
The Ministry of Economy of Ukraine by Order No. 20110 of August 7, 2024, approved changes to the form of the act drawn up based on the results of a scheduled (unscheduled) state supervision (control) event regarding compliance by a business entity with the requirements of legislation in the field of consumer rights protection.
The changes were made in accordance with the laws "On Protection of Consumer Rights", "On Basic Principles of State Supervision (Control) in the Field of Economic Activity", "On Housing and Communal Services" and with the aim of bringing the normative legal act into compliance with the requirements of the law. In particular:
- The list of questions regarding the implementation of the state supervision (control) measure has been clarified;
- The list of normative legal acts and regulatory documents, according to which a list of issues related to the implementation of state supervision (control) measures has been compiled.
